Ray Charles Foundation Sues To Stop Children Taking Back ...

Before his death, music legend Ray Charles gave $500,000 in trust to his children on the condition they would seek no claim to his musical estate. Now, some of the children appear to have reneged on the deal by triggering a controversial law that lets artists and their heirs reclaim copyright after 35 years.

The children want royalties to songs like ?I Got a Woman? and ?Mary Ann? which are now being paid to the Ray Charles Foundation, an organization that funds projects related to education and hearing impairment.

Charles, who died in 2004, has twelve children but only seven are named in the lawsuit.

The Ray Charles dispute is the second high profile case to emerge over so-called ?termination rights.? The first involves the lead singer of the Village People who is in California court in an effort reclaim ?YMCA? and other hits.

Studios and other content owners, who face the loss of valuable backlists, are attempting to rely on legal loopholes to avoid the transfers. One of these involves the ?work for hire? rule which says artists can?t claim rights if they make the creative work as an employee.

The purpose of the 35-year law, which is part of the 1978 Copyright Act, is to ensure that artists who signed bad deals when they were young can have a second bite at the apple.

In the case of Charles, the foundation is arguing that the studios already increased royalty terms once already and his heirs can?t try to sweeten the deal a second time. It is also saying some of the songs were works for hire and that the children are barred by contract from claiming the work.

Ray Charles was the subject of a 2004 Oscar-winning biopic Ray.

Now that St. Patrick?s Day has passed, the chances for Massachusetts Senator Scott Brown?s legislation to issue to 10,500 E-3 visas to Irish nationals may be over too. Brown had identified St. Patrick?s Day as the date by which he had hoped to maneuver S. 2005, the Irish Recognition and Encouragement Act or IRE, through the Senate. Instead, as of March 27, nearly two weeks after the parades have ended and the shamrocks wilted, S. 2005 has only 3 cosponsors.

The bill?s failure has mystified the media. In the days leading up to St. Paddy?s, journalists wrote glowingly about S. 2005 and pointed out that, if passed, it would reverse years of discrimination against the Irish inadvertently created when Brown?s predecessor, Teddy Kennedy, championed the Immigration and Nationality Act of 1965.

Said Brown?s spokesman John Donnelly:

?For decades, the Irish have been unfairly shut out by our immigration laws while immigration from many other countries has sharply increased.? [Immigration Bill Draws Ire from Advocates, by Erin Kelly, USA Today, March 22, 2012]

Brown?s bill duplicates a 2005 program that allowed 10,500 Australians to come to the United States on E-3 visas. The E-3?s fine print may also include immigration status relief through waivers for some illegal alien Irish currently living and (possibly) working in the United States. In other words, for those Irish already in America, they would likely receive an amnesty.

Reporters incorrectly assumed that since the Irish are white and speak English, then Brown?s bill should be acceptable to Congress and Americans who oppose more liberal immigration laws?two groups that are also mostly white and English speaking.

The media?s superficial analysis confirms its complete failure to understand the patriotic immigration reform?s message. More immigration, regardless of the country of origin, creates more population growth and brings with it the attendant social problems related to larger numbers of people.

And reporters totally missed the IRE?s biggest drawback. Although Brown has advertized his legislation as one that will bring exceptionally talented workers to the United States, the fact is that Irish nationals can qualify by having a high school diploma (or the equivalent). In the event he has neither, then two years of work experience can substitute. Of the nearly 20 million unemployed or underemployed Americans, tens of thousands are high school educated. To import 10,500 unskilled workers from Ireland or anywhere else is indefensible and inexcusable.

While Brown?s bill appears to have stalled, our side can never afford to take anything for granted. Brown is likely to continue to push for S. 2005 during his re-election campaign between now and November. See CAPS legislative alert here and contact your Senators.

Adele To The Rescue! Music Sales Up In 2011

It's been a bleak decade for the American recording industry, with sales dipping nearly every year since the pop explosion lead by 'NSYNC, Britney Spears and the Backstreet Boys. But there was finally a sliver of good news this week when the Recording Industry Association of America announced that total U.S. music sales grew in 2011 for the first time since 2004.

Don't get too crazy: Sales were only up 0.2 percent to just more than $7 billion. But to an industry that has been moving in the wrong direction for the past seven years, it was reason enough to celebrate.

It was a good news/bad news situation, though, as physical sales, which are mostly made up of CDs, were down by 7.7 percent. That was a narrower dip than in recent years but a dip nonetheless. That was more than made up, though, by a 9.2 percent rise in digital sales, which made up more than half of the industry's revenues for the first time in history.

Black Keys drummer Patrick Carney can complain all he wants, but the amount of cash being made from subscription services like Spotify, MOG and Rhapsody was up nearly 14 percent to $241 million, with total subscribers growing by 300,000 to 1.8 million.

In a year when Adele became the first artist to go double-platinum on iTunes — while her massive breakthrough, 21, helped goose digital and physical sales numbers by collectively topping more than 8 million in 2011 — digital sales were huge. Both unit sales (105 million) and revenue ($1 billion) were up more than 20 percent. Single downloads were up nearly 11 percent to 1.3 million.

And even as downloads gained ground on physical CD sales (more than 240 million sold, totaling $3.1 billion), the kids were still digging that old-school vinyl. Sales of records and revenue from that category were both up more than 30 percent to $119 million and 5.5 million copies.

This week a new wellness-focused incubator for startups launched in New York City: WellTech Funding. The six-month long incubation program seeks startups focused on consumer wellness solutions, including new online platforms, services, web or mobile apps or other consumer tools and products. The program is looking for both consumer-facing products and services as well as B2B offerings for wellness businesses.

?The most competitive candidates will be tackling an untapped market opportunity ? or unsolved problem ? within the expansive wellness market, and will be led by hard-working, passionate founders and teams,? WellTech states on its website. ?WellTech Funding seeks companies and solutions that are bold, but actually buildable, i.e., those with capital-efficient business models that can make major progress during the six-month WellTech-acceleration process.?

WellTech is just the latest health-related incubator to join the ranks of San Francisco-based Rock Health, New York-based Blueprint Health, and Chicago-based Healthbox. StartUp Health also recently announced its first class of entrepreneurs for its three-year ?academy? program. Welltech claims to be different from existing incubators and programs because of its focus on wellness. Other incubators may include some startups with a wellness focus, but WellTech aims to exclusively focus on prevention and wellbeing.

Leader of Mali military coup received US training

NAIROBI, Kenya -- The leader of the military coup that toppled the democratic government of the West African nation of Mali this week underwent basic officer training in the United States, the Obama administration acknowledged Friday.

Capt. Amadou Sanoga, who is the apparent leader of the group of junior officers that toppled the government of President Amadou Toumani Toure, "participated in several U.S.-funded International Military Education and Training (IMET) programs in the United States, including basic officer training," the U.S. military's Africa Command said in an email to McClatchy Newspapers.

The State Department confirmed Sanoga's U.S. connection in a separate email.

It was not immediately known which training courses Sanoga had participated in. The IMET programs can include a wide range of activities, including human rights training and study at one of the U.S. military's war colleges.

Whether U.S. officials have been in touch with Sanoga, who declared himself the head of the National Committee for the Restoration of Democracy and the State, since the coup also was unknown. In an email, State Department African affairs spokeswoman Hilary Renner said only that U.S. diplomats in Mali's capital, Bamako, are "seeking to contact the mutiny leaders to express the U.S. and international position that the civilian elected government must be fully restored without delay."

Sanoga's U.S. ties complicate what was already an inconvenient development in the regional counterterrorism strategy for the United States, which now will have to decide how to deal with a military junta that it has vowed to reject in a country that is a significant front in the war against terror.

"At this moment the United States is pausing any planned military equipment or training programs to the Malian military," Renner wrote. "We remain committed to building the long-term counterterrorism capacities of our partners in the region, including Mali. The restoration of a strong constitutional process and good governance at all levels is a critical priority for counterterrorism efforts."

The whereabouts of President Toure remain unknown, though Renner said "we have seen reports" that the president is safe. She urged the coup leaders to protect the "well-being" of all those they had detained.

Sanoga and his fellow officers have moved quickly to consolidate power. Unless they face a backlash among their military peers or a regional effort to unseat them, the international community might have no choice but to deal with the young new rulers, like it or not, analysts said.

"Mali is what many consider the poster child for democracy in West Africa. It is also an aid darling. What are all these donor countries going to do? It's completely unclear," said Benjamin Soares, a Mali expert at the African Studies Center in Leiden, the Netherlands.

"Of course, there is a long history of coups in the region. Western donors usually say they won't deal with these governments, but they almost always eventually do so," Soares said.

The U.S. military has supported the Mali military extensively over the past decade, and the country has become a significant partner in the U.S. efforts to curb North Africa's shadowy al-Qaida affiliate, al-Qaida in the Islamic Maghreb, or AQIM.

In addition to its involvement in the International Military Education and Training program, Mali has also participated in the Trans Sahara Counter Terrorism Partnership, which is intended to strengthen bilateral military ties with the U.S. and supports counterterrorism coordination across the region's different militaries. Mali also recently hosted U.S. soldiers in a joint logistical exercise named Atlas Accord 12.

UN Council demands Syria carry out peace plan

The UN Security Council Wednesday demanded that Syria immediately implement a peace plan by UN-Arab League envoy Kofi Annan, even as the army pounded a rebel-held area of Homs, raising the death toll.

Following intense negotiations between the major powers, Russia and China signed on to a Western-drafted text which calls on President Bashar al-Assad to work toward a cessation of hostilities and a democratic transition.

The presidential statement, which carries less weight than a formal resolution, gives strong backing to a six-point plan that Annan put to Assad in talks in Damascus this month. It also gave a veiled warning of future international action.

But amid the UN debate, Syrian army troops rained shells on the Homs district of Khaldiyeh on Wednesday, as the toll from two days of bombardment rose to at least 19 dead and dozens wounded, activists said.

"Khaldiyeh is being bombed, with shells and rockets, for a second day," Hadi Abdullah of the Syrian Revolution General Commission told AFP, reached by telephone from Beirut.

The Syrian Observatory for Human Rights, a Britain-based monitoring group, said at least five civilians were killed and dozens wounded in Wednesday's shelling, a day after 14 civilians were killed in the same district. It said two children were among the latest deaths.

The Security Council statement called on "the Syrian government and opposition to work in good faith with the envoy towards a peaceful settlement of the Syrian crisis and to implement fully and immediately his initial six-point proposal."

It said Annan should regularly update the council on his efforts. "In the light of these reports, the Security Council will consider further steps as appropriate," the statement adds.

The council also "expresses its full support" for Annan's efforts to facilitate a Syrian-led transition to a "a democratic, plural political system" -- which some diplomats said put additional political pressure on Annan.

In a sign of the new diplomatic urgency over Syria, the Security Council also agreed on a press statement, proposed by Russia, which "condemned in the strongest terms" bomb attacks in Damascus and Aleppo at the weekend.

Russia and China have vetoed two resolutions on Syria and their opposition to any tough action against Assad has left the major powers in deadlock on ways to end the bloodshed in Syria, where the UN says well over 8,000 people have been killed in the last year.

Britain's UN ambassador, Mark Lyall Grant, said the statement was agreed unanimously by the council, despite its divisions.

"This sends precisely the strong and united message to the Syrian government and all other actors in Syria that they need to respond and respond quickly and immediately to the six point plan," said Lyall Grant, who formally read the statement as president of the council for March.

In Washington US Secretary of State Hillary Clinton praised the UN statement on Syria and warned Assad to carry out the peace plan or face "increasing pressure."

"To President Assad and his regime, we say, along with the rest of the international community, take this path, commit to it, or face increasing pressure and isolation," Clinton told reporters.

European countries still want to press for a full binding Security Council resolution on the crisis in Syria however.

French envoy Gerard Araud called it "a small step by the Security Council in the right direction."

"A resolution is still on the table and we hope we will manage to obtain a Security Council resolution," Araud told reporters.

There were "very tough" negotiations with Russia and its allies on the text of the statement, a diplomat involved in the talks said.

A lot of the language was toned down with "further measures" within seven days of the statement changed to "further steps" with no deadline.

But Russia's Foreign Minister Sergei Lavrov welcomed the Security Council's move.

"The document does not contain any ultimatums, threats or assertions about who is guilty," Lavrov said in Berlin after talks with German leaders.

Syrian opponents said they feared a repeat of the month-long battering that killed hundreds in the Baba Amr district of Homs before the army moved in on March 1 after a pullout by the Free Syrian Army (FSA), made up mostly of army deserters.

Thousands of residents who fled Baba Amr and other neighborhoods of the city in central Syria had taken refuge in Khaldiyeh, "the last front left" in Homs.

Also in Homs, activists uncovered 39 bodies in the Rifai sector of town, said Abdullah. They had probably been killed at the same time as the 48 women and children whose mutilated bodies the FSA found in Homs on March 12.

At the time, the opposition charged it was a massacre carried out by government forces after their capture of Baba Amr, while Damascus said it was the work of "armed terrorist gangs," which it blames for the year-long revolt.

UK boy band One Direction breaks Billboard record with debut album

LONDON/LOS ANGELES (Reuters) - British boy band One Direction has become the first UK group to debut at No. 1 in the U.S. Billboard 200 album chart, adding another victory in their whirlwind success story.

The band sold more than 176,000 copies of their debut album "Up All Night", making chart history in the United States, with the record soaring straight to the top of the digital charts within minutes of its official release on March 13th, a statement from the band's label Syco said on Wednesday.

One Direction's debut album knocked last week's chart topper, Bruce Springsteen's "Wrecking Ball," from No. 1 and came in ahead of Adele's Grammy-winning album "21," which remained at No. 2 with 148,000 copies sold last week.

The boy band came together on Britain's "The X Factor" television talent contest after judge Simon Cowell suggested they sing together as a band rather than on their own.

Niall Horan, Zayn Malik, Liam Payne, Harry Styles and Louis Tomlinson, all aged between 18 and 21, joined forces and became hot competition during the 2010 edition of "The X Factor," finishing in third place.

"When we got put together as a group, we couldn't imagine ourselves coming to America, let alone releasing our album here, so for us to be sitting at the top of the U.S. album charts is unbelievable," Horan said in a statement.

Over 10,000 fans turned up for the band's first live TV performance on the NBC's Today Show in New York.

The band have also racked up more than 204 million views on video website YouTube, have 12 million followers on Twitter and 3.6 million fans on Facebook.

"I couldn't be happier for One Direction, it is an incredible achievement," Cowell said.

One Direction's debut single "What Makes You Beautiful" won a BRIT Award in February and sold more than 131,000 copies in its first week. Their entry at No. 28 on the Billboard Hot 100 chart also marked the highest singles debut from a British band since the Spice Girls' "Wannabe" in 1997.

"It's beyond a dream come true for us," fellow band member Styles said.

One Direction were signed to Cowell's Syco label in 2011 in partnership with Columbia Records in the United States.

Syco Entertainment is a music television, film and digital joint venture between Cowell and Sony Music Entertainment whose assets include The X Factor and Got Talent, as well as artists such as Leona Lewis, Susan Boyle, Il Divo, Cher Lloyd, One Direction & Labrinth.

If you're a lucky fan of everyone's favorite console modder Ben Heck, you could win the freshly-built hands-free robotic luggage lovingly nicknamed "Doug." Or you can just catch the latest episode of Heck's show to figure out how to build an obedient wheeled suitcase of your very own -- and wink at all of the requisite R2-D2 references. Rick Santorum?s campaign released this position paper on Santorum?s campaign website.? It is undated and unsigned, but it speaks in the first person, using ?I,? so I?ll infer Santorum approved it.?? The paper?s comments are in red.? My thoughts are in blue:

Enforcing laws against illegal pornography

America is suffering a pandemic of harm from pornography.? A wealth of research is now available demonstrating that pornography causes profound brain changes in both children and adults, resulting in widespread negative consequences. Addiction to pornography is now common for adults and even for some children.

A pandemic?? What measurable harm does?Santorum?cite???Santorum does not cite one peer-reviewed study as a point of authority.? If this was a high school English essay, it would fail for making only claims, but citing no points of authority.? A ?wealth of research??? How about naming one respected research study or paper?? Profound damage to the brain?? Like what?? This is such snake oil salesmanship.? Negative consequences?? Such as??? Porn ?addiction? is common?? How about giving some data?? Even if adults are ?addicted? to sexual imagery, is this a problem?? We don?t suggest men who want sex regularly have a sexual ?addiction? problem.? A regular, consistent, and healthy appetite for sexual stimulation is not an addiction.? It?s a disservice to people who genuinely have addiction problems to characterize a regular?appetite for sexual imagery as an addiction.

The average age of first exposure to hard-core, Internet pornography is now 11.?Pornography is toxic to marriages and relationships. It contributes to misogyny and violence against women.? It is a contributing factor to prostitution and sex trafficking.

What?s the average ?first exposure? children have to violent actions where people or cartoons maim or kill each other?? Is there any reputable study that suggests a child is measurably harmed from viewing hard-core (or soft-core, or intermediate to middleweight-core) sexual imagery?? To answer this rhetorical question:? No, there is not.? It?s all speculation from fearmongers like Santorum.??Is pornography?toxic to marriages and relationships?? No, it is not commonly harmful to marriages where ?pornography? is not presumed to be a negative thing.? Many more marriages would probably dissolve if men did not have regular sexual imagery?to address their more frequent (on average) sexual drives.? Men can safely masturbate in the privacy of their homes, not damaging their relationship commitments, and reducing their number of partners and the transfer rates and prevalence of STDs.? Porn doesn?t contribute to violence against women any more than ?Law & Order? or the next summer action movie or horror flick.? It is a far healthier thing to allow people to consider their curiosities through viewing fictional content than for them to try everything in real life.? Watching ?Harry Potter? doesn?t contribute to the prevalence of wizardry.

Every family must now be concerned about the harm from pornography. As a parent, I am concerned about the widespread distribution of illegal obscene pornography and its profound effects on our culture. ? For many decades, the American public has actively petitioned the United States Congress for laws prohibiting distribution of hard-core adult pornography.

Who is Santorum going to set up on the ?Porn-Core Rating Committee????Which of his buddies will get that fortunate appointment where they sit in a dark room together, or separately in the privacy of their cubicle and computer monitor, to evaluate the literally millions of new sexual imagery videos and photographs created by Hollywood, the international porn industry, the fashion industry, and amateur photographers and videographers?? What a fuckin? joke.? Pun intended.? The ?American Public,? at least a majority of them, has?not petitioned Congress for laws prohibiting hard-core porn ? at least not for the last few decades.??Men in general?have not had a free hand to sign the petition ? at least not since the advent of the home PC and a fast internet connection.? If the American Public really wanted this to happen, such a movement would have already virally set Facebook ablaze.? Conservatives are so weird on sexual issues sometimes.? It?s like that ?One Million Moms? group ? who by the way, still have only about 45,600 members ? the few trying to control the actions, preferences, and liberties of the many.

Congress has responded.? Current federal ?obscenity? laws prohibit distribution of hardcore (obscene) pornography on the Internet, on cable/satellite TV, on hotel/motel TV, in retail shops and through the mail or by common carrier. Rick Santorum believes that federal obscenity laws should be vigorously enforced.? ?If elected President, I will appoint an Attorney General who will do so.???

Yawn.? First, this is not true ? Congress has not banned the distribution of hard-core porn or any other (insert your favorite porn adjective here) porn.? Second, it?s mindless saber rattling.? Third, if Santorum had?more intelligence, he?d know this is bad politics and misguided social policy ? pandering to an?under-educated social minority ? to the detriment of a diverse majority.

The Obama Administration has turned a blind eye to those who wish to preserve our culture from the scourge of pornography and has refused to enforce obscenity laws. While the Obama Department of Justice seems to favor pornographers over children and families, that will change under a Santorum Administration.?

?Scourge of pornography??? Is that like the ?scourge of teen pregnancy? or the ?scourge of diminishing church attendance??? If Obama?s cool with both healthy families and healthy pornography ? that sounds like a more even-keel, mature, and informed position.

I proudly support the efforts of the War on Illegal Pornography Coalition that has tirelessly fought to get federal obscenity laws enforced.? That coalition is composed of 120 national, state, and local groups, including Morality in Media, Family Research Council, Focus on the Family, American Family Association, Cornerstone Family Council of New Hampshire, Pennsylvania Family Institute, Concerned Women for America, The Ethics & Religious Liberty Commission of the Southern Baptist Convention, and a host of other groups.? Together we will prevail.

I hope not, because that would be silly nonsense.? It would be like trying to re-institute alcohol prohibition.? It is such a silly aspiration as to be almost not?be worth discussion ? except that a?guy?running for the Republican Presidential candidacy thinks discussing the policy will garner him some more votes.

But Santorum is running for President of the United States and people need to point out when he?s being self-serving and stupid.
